Chief Judge at Madras High Court, Justice T Sudanthiram, has delivered a verdict setting free the orthopaedic surgeon L Prakash from the charges of alleged involvement in cyber porn case and narcotics issue, on Thursday
He had been sentenced to a 10-year imprisonment by the district court. However, the high court has released him from the narcotics case as the prosecution failed to produce any justifications.
“The evidence submitted by the prosecution with regard to the confession of Prakash and the seizure of the contraband from his clinic are not insufficient”, said Justice Sudanthiram.
Being arrested on December 24, 2001, Prakash was identified as the first man convicted under the Information Technology Act.
He had been alleged to have developed illicit relations with his patients and uploading their obscene pictures on the web. His brother was allegedly involved with him.
He had been held under the provisions of Section 67 of the Information Technology Act, along with the Indecent Representation of Women (Prohibition) Act, 1986 read with Section 27 of the Arms Act, 1959, and 120-B(ii) of the Indian Penal Code.
He had been sentenced to life imprisonment in 2008, under the above charges.
